1. Definitions and Purpose

  • BorgHive: Digital platform enabling the integration of AI chatbots with WhatsApp, Discord, websites, and other digital environments for automation, intelligent communication, and multimedia support.
  • Service: All functionalities provided through this website by Borg Design SRL, CUI 14837428, J40/8118/2002, Address: Str. Ing. Ștefan Hepiteș 16A, Et. P, Sector 5, Bucharest, 050196, Romania. See our code of conduct.
  • User: Any natural or legal person, from the EU or outside it, using BorgHive services.
  • Chatbot/Assistant: AI-powered software integrated into various platforms to interact automatically with users.
  • Action: Any integration or activation of features (WhatsApp, Discord, multimedia processing, document handling, etc.).

2. Acceptance of Terms

Use of the BorgHive platform implies full acceptance of these Terms and Conditions. If you do not agree with them, please discontinue usage of our services.

3. BorgHive Services

  • 3.1. Multi-platform Integration
    • Full integration with WhatsApp, Discord, and future digital platforms.
    • Direct access to OpenAI-based chatbots for efficient and natural communication.
  • 3.2. Personalized Chatbots – Tailored for each business, optimized for conversions and support.
  • 3.3. Multimedia Support – Sending and receiving images, audio, and files.
  • 3.4. Real-time Interaction – Fast and interactive AI conversations.
  • 3.5. Efficiency and Scalability – Automation, reduced costs, and ability to scale as usage grows.

4. Packages and Limitations

  • Free Plan: 200 messages/month, 5 action, 2 assistant, GPT-4o-mini, BorgHive branding messages.
  • Standard Plan: 5000 messages/month, 2 actions, 1 assistants, GPT-4o-mini, no BorgHive branding messages.
  • Pro Plan: Fully configurable, branding disabled, access to premium AI models and advanced features.

Actions include platform integrations (WhatsApp, Discord, etc.) and features such as images, audio, and document handling.

Users may configure notifications and limits for message volume and balance management.

5. User Obligations

  • Use the platform legally, without spam, fraud, or abuse.
  • Maintain account confidentiality—do not share authentication credentials.
  • Respect BorgHive and third-party intellectual property rights.

6. Payment and Refund Policy

  • Payment methods: Credit/debit card or bank transfer.
  • Plans may be billed monthly or annually.
  • Cancellation stops future renewals; services remain active until the end of the paid cycle.
  • Used periods are non-refundable except where required by law.

7. Return Policy

  • Services are delivered digitally and become active immediately after confirmed payment.
  • No standard return policy applies as with physical goods.
  • If the service does not operate as described and the issue cannot be resolved, users may request a proportional refund for the unused subscription period.
  • Refunds are processed within 14 calendar days from approval.

8. Complaint Policy

  • Users may submit complaints regarding functionality, billing, or other contractual aspects.
  • Complaints may be sent to support@borghive.ai or by mail to Borg Design SRL, Str. Ing. Ștefan Hepiteș 16A, Et. P, Sector 5, Bucharest, Romania.
  • Email confirmation within 48 hours of receiving the complaint.
  • Maximum resolution timeframe: 30 calendar days.
  • If more investigation is needed, users will be informed about deadline extensions.

9. Privacy Policy

  • Personal data is processed according to GDPR, strictly for service delivery.
  • No data is shared with third parties without consent unless required by law.
  • Users may consult the GDPR page for complete rights and protections.

10. Limitation of Liability

  • No guarantee against technical errors or continuous uptime.
  • BorgHive is not responsible for losses caused by third parties or AI-generated output.
  • Users are fully responsible for content generated by their chatbots.

11. Sanctions and Penalties

  • Fraud, exploitation of platform vulnerabilities, or abusive behavior leads to permanent account suspension.
  • BorgHive may pursue legal action to recover damages.
  • Blocking decisions are final and irreversible.

12. Modification of Terms

Terms may be updated at any time, with prior notice via email or platform announcements. Continued use implies acceptance of revised terms.

13. Governing Law and Jurisdiction

This agreement is governed by Romanian law and applicable EU legislation. Disputes will be resolved amicably or before competent Romanian courts.
